Terms and Conditions
OBJECT
- GSX Portugal Unip. Lda. (“GLOBALSPORT”), headquartered at Rua D. Manuel Vieira de Matos, nº 70, 5050-345 Poiares, with a share capital of €5,000, registered with the Commercial Registry Office of Sintra under registration and corporate identification number 514 779 012, as a provider of tourist animation activities, other unspecified sports activities, and the organisation of fairs and similar events, offers its customers (“Clients”) the possibility of acquiring services and products associated with the services it provides.
- These Terms and Conditions (“Terms and Conditions”) govern the access and use of all websites under domains owned by GLOBALSPORT, through which GLOBALSPORT Clients can consult information about the products and services provided by GLOBALSPORT (“Products and Services”) and place an order (“Order”) and make a purchase electronically.
- The Products and Services purchased will be delivered in Portugal or abroad, depending on the countries available in the purchase form.
3.1. Digital Products and Services will be delivered to the email address provided by the Client. - All Products and Services available in the Online Store comply with the requirements set out in Portuguese legislation.
- The elements and information provided by the Client at the time of the Order will have full legal effect, and the Client may not claim the absence of a signature as grounds for failure to comply with the obligations assumed.
- Placing an Order and purchasing Products and Services presupposes that the Client has read, understood and accepted the provisions of these Terms and Conditions.
- GLOBALSPORT reserves the right to amend or revise these Terms and Conditions at any time, with any changes published at www.globalsport.pt
INFORMATION ABOUT PRODUCTS AND SERVICES
- The Products and Services have the characteristics described in the Online Store. The use of the Products and Services by the Client after purchase is the sole responsibility of the Client.
- GLOBALSPORT cannot guarantee the accuracy and correctness of the information provided in the Online Store about the Products and Services at all times, but undertakes to correct any errors as soon as they are identified.
- If, due to circumstances not attributable to GLOBALSPORT – including human or system errors – it is not possible to guarantee the delivery of all ordered Products and Services, GLOBALSPORT undertakes to inform the Client of this, and the Client shall have the right to cancel the Order and be refunded any amount already paid.
- GLOBALSPORT reserves the right not to fulfil an Order if errors are identified in the prices or characteristics of the Products and Services resulting from technical problems beyond its control, and will inform the Client accordingly.
- GLOBALSPORT reserves the right to change, at any time, the commercial conditions of the Products and Services presented in the Online Store, including prices, features and associated services.
- All prices shown include VAT at the prevailing legal rate.
- Transaction fees may be applied by the online payment service providers used by the Online Store. In the case of the registration platform, transaction fees for payments made via Multibanco references are automated, and the service provider that applies the lowest fee on the total purchase value of the Products and Services will be selected.
- The offer presented in the Online Store is limited to existing stock.
ORDER REQUEST
- completion of the Order. The omission or inaccuracy of such data is the sole responsibility of the Client and may result in the Order not being fulfilled.
- The Client assumes full and exclusive responsibility for the authenticity, accuracy, truthfulness and timeliness of the data provided at the time of the Order. If any of the data provided proves to be incorrect or insufficient, GLOBALSPORT reserves the right to prohibit future purchases and to block access to the Online Store.
- To order a Product or Service, the Client must select the “Add to Cart” option found next to the description of the desired Product or Service.
- The Client may, up until the time of dispatch of the Product or Service, review or amend their Order, including changing the quantity of Products or Services requested or removing items from the Order.
- After selecting the Products and Services, the Client must confirm the Order by entering the required details and selecting the preferred payment method. Once all elements have been validated by the Client, the Order will be completed and the Client will receive an email with the corresponding Order information.
ORDER DELIVERY
Delivery to the address provided by the Client:
The delivery address must be indicated by the Client during the purchase process – “delivery address”. Orders for delivery to PO boxes in Portugal or other countries are not accepted. The Order will be dispatched according to GLOBALSPORT’s logistical availability, except in cases of stock shortages. Delivery will be carried out by courier to the address provided by the Client, on working days between 9:00 am and 6:00 pm in Portugal. In other countries, delivery will follow the courier’s schedule applicable in the country concerned.
If the Client is not present at the specified delivery address, they should follow the instructions left by the courier in the mailbox, where applicable. If delivery is not possible, the Order will be returned to GLOBALSPORT and cancelled – any expenses incurred in this process will be charged to the Client by GLOBALSPORT.
Delivery to the email address provided or used by the Client:
Delivery will be sent to the email address entered by the Client in the purchase or registration form. The insertion, validity and proper functioning of the Client’s email address are the sole responsibility of the Client. Depending on the email settings, the message may be redirected to the Client’s spam or junk folder.
ORDER PAYMENT
The Client has the following payment methods available:
a) Multibanco: The Order may be paid via Multibanco, at an ATM or through online banking. At the time of purchase, the Client will be provided with the Entity / Reference / Amount details and will have three (3) consecutive days to complete the payment. After this period, if the Order has not been paid, GLOBALSPORT will proceed with its cancellation. The Order will only be processed after payment has been received – VALID IN PORTUGAL ONLY.
b) PayPal: Payment via PayPal is a secure method that uses your credit card details. For more information about this payment method, visit www.paypal.com.
ORDER CANCELLATION
- The Order cannot be cancelled at the Client’s request once payment has been made.
- The Order may also be cancelled by decision of GLOBALSPORT, which reserves the right not to accept Orders if any inconsistency is found in the personal data provided by the Client or if Terms and Conditions are not complied with.
ORDER RETURN
Returns are not accepted.
WARRANTY
- The warranty is provided under the terms and conditions established by the manufacturer of the relevant Products and Services. If the Products or Services are in digital format, no warranty shall apply.
- After the warranty period, or in cases where the warranty is excluded due to the occurrence of an exclusion cause, any costs associated with repairs shall be borne by the Client.
- To benefit from the warranty on the Products and Services, the Client must retain the invoice received at the time of delivery of the Order as proof of purchase.
CUSTOMER OBLIGATIONS
- The Client declares that they have the necessary legal capacity to accept these Terms and Conditions.
The Client undertakes to:
a) comply with these Terms and Conditions and all applicable legislation;
b) provide accurate, truthful and up-to-date information;
c) not use an identity other than their own or falsify or conceal their identity in any way;
d) not carry out any illegal activities or activities that infringe the rights of GLOBALSPORT, its Clients or other Internet users;
e) not interfere with or impair, in any way, the use of the Online Store or violate any rules, regulations or standards of networks connected to the use of the Online Store;
f) not introduce, transmit or make accessible, in any way, any material containing viruses, programs, systems or files that may destroy, damage or limit the functionality and/or capacity of any computer, including software, hardware or electronic communications equipment.
SUSPENSION OF THE ONLINE STORE
- GLOBALSPORT reserves the right to suspend or terminate access to the Online Store, as well as to request confirmation of any information provided by the Client.
- GLOBALSPORT reserves the right to take any measures it deems necessary to safeguard its rights in the event of a violation or attempted violation of these Terms and Conditions. It may choose to suspend or block access to and use of the Online Store, without the Client having any right to compensation or indemnity as a result.
ONLINE STORE MAINTENANCE
- GLOBALSPORT undertakes to provide access to the Online Store on a regular and continuous basis, except when this is not possible due to unforeseen overload of distribution networks and/or the IT systems on which it relies, or due to force majeure (extraordinary or unforeseeable situations beyond GLOBALSPORT’s control). In such cases, GLOBALSPORT may not be able to guarantee 100% availability, 24 hours a day, but undertakes to restore normal operation as soon as possible in the event of an interruption.
- GLOBALSPORT does not guarantee that the Online Store will operate without interruption or that it will be free from errors, viruses or other harmful elements.
- GLOBALSPORT commits to restoring access to the Online Store as soon as technically possible whenever any malfunction under its responsibility causes a disruption in availability.
PRIVACY AND PERSONAL DATA PROTECTION
- GLOBALSPORT guarantees, at all times, the confidentiality and protection of all data provided by Clients, particularly personal data.
- The Client’s personal data collected at the time of the Order will be processed and stored electronically by GLOBALSPORT, as the data controller. These data will be used within the scope of the contractual relationship with the Client, in accordance with applicable legislation and for the specific purposes for which they were collected.
- The Client is guaranteed the right to access, rectify and update their personal data at no cost.
- The Client commits to respect and comply with all legal provisions regarding privacy protection in the electronic communications sector.
LIABILITY
- Without prejudice to the provisions of these Terms and Conditions, as the Products and Services made available by GLOBALSPORT through the Online Store operate on an open network and are therefore subject to interference, interruptions, disconnections or other anomalies – namely as a result of malfunctions, overloads, line congestion or other issues beyond GLOBALSPORT’s control – the Client expressly acknowledges that no liability may be attributed to GLOBALSPORT for any actual or potential damages, direct or indirect, that may result for the Client from such occurrences.
- GLOBALSPORT shall not be held liable, except in cases of wilful misconduct or gross negligence, for any losses suffered by the Client resulting from:
a) Delays, interruptions, errors or suspensions in communications caused by factors beyond its control, including any deficiencies or failures in the communication network or services provided by third parties, computer systems, modems, connection software, or computer viruses;
b) Loss of data, as well as suspension, interruption or any other malfunction of the Online Store;
c) Accidental or intentional damage caused to the Client by third parties or resulting from their use of the Online Store. - GLOBALSPORT has implemented adequate and appropriate security measures for data transmission over the Internet. However, as data transmitted online is not fully protected against possible breaches or misuse, the Client acknowledges that they are solely responsible for safeguarding any usernames, access codes, other confidential credentials and all sensitive information.
- GLOBALSPORT shall not be held liable for any defects, incorrect operation or incompatibilities, particularly with the Client’s hardware. It is not obliged to provide support for use of the Online Store, nor does it guarantee that it will fulfil the purposes intended by the Client.
- All operations carried out in the Online Store are presumed to be performed by the Client. GLOBALSPORT shall not, under any circumstances, be held responsible for any abusive or fraudulent use.
- The Client is solely responsible for their use of all content and functionalities available on the Online Store and shall be fully liable for any damage, direct or indirect, caused to themselves, to GLOBALSPORT or to any third parties, arising from such use. The Client undertakes to pay any compensation that may result from any action, claim or judgement brought against them.
- The Client is also responsible for:
a) Acquiring and maintaining the equipment (hardware) and computer programmes (software) necessary to access the Online Store;
b) Bearing any costs associated with accessing the Online Store;
c) All information made available by them on the Internet. - The Client acknowledges that data circulating on the Internet may be protected by copyright or industrial property rights and, as such, assumes full responsibility for the use and storage of information collected online.
- GLOBALSPORT does not guarantee that the characteristics of the Products and Services purchased through the Online Store will meet the Client’s expectations.
INTELLECTUAL PROPERTY
The Online Store is a website registered by GLOBALSPORT, and the services provided through it are its responsibility. All trademarks, logos and symbols used on the Online Store are the property of GLOBALSPORT, or are used with the appropriate authorisation.

APPLICABLE LAW AND JURISDICTION
- For all matters not expressly regulated by these Terms and Conditions, Portuguese law shall apply.
- In the event of any dispute concerning the validity, effectiveness, interpretation, integration, application or enforcement of these Terms and Conditions, GLOBALSPORT and the Client agree to submit to the exclusive jurisdiction of the Court of the District of Porto, expressly waiving any other jurisdiction.
