Terms and Conditions
OBJECT
1. GSX Portugal Unip. Lda. (“GLOBALSPORT”), headquartered at Rua D. Manuel Vieira de Matos, nº 70, 5050-345 Poiares, with a share capital of €5,000, registered at the Commercial Registry Office of Sintra, with registration and corporate identification number 514 779 012, as an organization of tourist animation activities, other unspecified sports activities, organization of fairs and other similar events, provides its customers (“Clients”) with the possibility of acquiring services and products associated with the services it provides.
2. These Terms and Conditions (“Terms and Conditions”) govern the access and use of all internet sites with domains owned by GLOBALSPORT and through which GLOBALSPORT Clients can consult information about the products and services provided by GLOBALSPORT (“Products and Services”) and proceed, electronically, to place an order (“Order”) and make a purchase.
3. The Products and Services purchased will be delivered in Portugal, or outside the country according to the countries available in the purchase form.
3.1. Digital Products and Services will be delivered to the email address provided by the Client.
4. All Products and Services available in the Online Store comply with and meet the requirements set out in Portuguese legislation.
5. The elements and information transmitted by the Client at the time of the Order will have full legal effect, and the Client cannot claim lack of signature for non-compliance with the obligations assumed.
6. The Order and acquisition of Products and Services presuppose the reading, knowledge, and acceptance of the provisions in these Terms and Conditions.
7. GLOBALSPORT reserves the right to, at any time, change or revise these Terms and Conditions, with any changes being disclosed at www.globalsport.pt
INFORMATION ABOUT PRODUCTS AND SERVICES
1. The Products and Services have the characteristics indicated in their description in the Online Store, and the use made by the Client after purchasing the Products and Services is the sole responsibility of the Client.
2. GLOBALSPORT cannot guarantee, at all times, the accuracy and correctness of the information provided in the Online Store about the Products and Services, but undertakes to correct any errors as soon as they are detected.
3. If, due to a fact not attributable to GLOBALSPORT, including human or computer errors, it is not possible to guarantee the delivery of all ordered Products and Services, GLOBALSPORT commits to inform the Client of this fact, and the Client will have the right to cancel the Order placed, being refunded the amount already paid.
4. GLOBALSPORT reserves the right not to complete an Order if errors are found in the values or characteristics of the Products and Services that result from technical problems beyond its control, informing the Client of this fact.
5. GLOBALSPORT reserves the right to change at any time the conditions of commercialization of the Products and Services presented in the Online Store, including price, characteristics, and services.
6. All prices mentioned include VAT at the current legal rate.
7. Transaction fees may be applied by online payment service providers that the Online Store uses. In the case of the registration platform, transaction fees for payments through Multibanco references are automated, with the service provider that charges the lowest fee on the total value of the Products and Services purchased by Clients being selected.
8. The offer presented in the Online Store is limited to existing stock.
ORDER REQUEST
1. The data marked as mandatory at the time of the Order request are essential for the completion of the Order. The omission or inaccuracy of such data is the sole responsibility of the Client and may result in the non-completion of the Order.
2. The Client assumes full and exclusive responsibility for the authenticity, accuracy, truthfulness, and timeliness of the data provided at the time of the Order. If any of the data provided proves to be incorrect or insufficient, GLOBALSPORT reserves the right to prohibit future purchases and block access to the Online Store.
3. To order a Product and Service, the Client must select the option “Add to Cart” found next to the description of the desired Product and Service.
4. The Client may, until the time of dispatch of the Product and Service, verify or modify their Order, and may also change the number of Products and Services desired or exclude Products and Services from their Order.
5. After choosing the Products and Services, the Customer must confirm the Order and, for this purpose, enter the requested data and choose the preferred payment method. After validation of all elements by the Customer, the Order will be completed and the Customer will receive an email with information regarding the Order.
ORDER DELIVERY
Delivery to address provided by the Customer: The delivery address will be indicated by the Customer during the purchase process – “delivery address”. Orders for delivery to PO boxes in Portugal and other countries are not accepted. The Order will be dispatched according to GLOBALSPORT’s logistical availability, except in cases of stock shortage. Delivery will be made by courier to the address provided by the Customer, on working days between 9:00 AM and 6:00 PM in Portugal; in other countries, it will be according to the courier’s schedule in the respective country. If the Customer is not at the delivery address provided, they should follow the information that the courier may leave in the mailbox. If delivery is not possible, it will be returned to GLOBALSPORT and cancelled – expenses associated with this process will be charged by GLOBALSPORT
Delivery to the email address provided or used by the Customer: The delivery will be sent to the email entered by the Customer in the purchase or registration form. The insertion, validity, and accuracy of the Customer’s email address will always be the responsibility of the Customer. According to settings, the sent email may be redirected to your SPAM folder.
ORDER PAYMENT
The Customer has the following payment methods available:
a) Multibanco: The Order can be paid via Multibanco, at an ATM or through online banking. At the time of purchase, the Customer is informed about the Entity / Reference / Amount and has 3 (three) consecutive days to make the payment. After this period, if the Order has not been paid, GLOBALSPORT will proceed with its cancellation. The acceptance of the Order will begin after its payment – VALID ONLY IN PORTUGAL.
b) PayPal: Payment by PayPal is a secure method which uses your credit card details. For more information about this payment method, visit www.paypal.com.
ORDER CANCELLATION
1. The Order cannot be cancelled at the Customer’s request once the respective payment has been made by the Customer.
2. The Order may also be cancelled by decision of GLOBALSPORT, which reserves the right not to accept Orders when it verifies any non-conformity with the personal data provided by the Customer or if these Terms and Conditions are not complied with.
ORDER RETURN
Returns of orders are not accepted.
WARRANTY
1. The warranty is provided under the terms and conditions established by the manufacturer of the Products and Services in question; if these are in digital format, they will not have a warranty.
2. After the warranty period, as well as in situations where the warranty is excluded due to the verification of a cause for exclusion, the costs inherent to any repairs will be borne by the Customer.
3. To benefit from the warranty of the Products and Services, the Customer must keep the invoice delivered at the time of receipt of their Order as proof of purchase.
CUSTOMER OBLIGATIONS
1. The Customer declares to have the necessary legal capacity to accept these Terms and Conditions.
2. The Customer commits and obliges to:
a) respect these Terms and Conditions and applicable legislation;
b) provide accurate, truthful and current data;
c) not use an identity other than that of the Customer or falsify or conceal their identity in any way;
d) not carry out illegal activities or activities that violate the rights of GLOBALSPORT or its Customers or other Internet users;
e) not interfere with or condition, in any way, the use of the Online Store or violate any rules, regulations or standards of networks connected to the use of the Online Store;
f) not introduce, transmit or make accessible in any way material containing viruses, programs, systems or files that destroy, damage or limit the functionality and/or capacity of any computer, including software and hardware or electronic communications equipment.
SUSPENSION OF THE ONLINE STORE
1. GLOBALSPORT reserves the right to suspend or terminate access to the Online Store, as well as to request confirmation of any information provided by the Customer.
2. GLOBALSPORT reserves the right to adopt all measures it deems necessary to safeguard its rights in case of violation or attempted violation of these Terms and Conditions, and may choose to suspend or block access to and use of the Online Store, without the Customer having the right to any compensation or indemnity as a result of such action.
ONLINE STORE MAINTENANCE
1. GLOBALSPORT commits to providing access to the Online Store on a regular and continuous basis, except when this is not possible due to unforeseeable overload of distribution networks and/or computer systems on which it relies, or due to force majeure situations (situations of an extraordinary or unforeseeable nature, external to GLOBALSPORT and which cannot be controlled by it), in which cases GLOBALSPORT may not guarantee its 100% operation 24 hours a day, and also commits to regularizing the situation as soon as possible in case of interruption.
2. GLOBALSPORT does not guarantee that the Online Store will function uninterruptedly or that it will be free from errors, viruses, or other harmful elements.
3. GLOBALSPORT commits to restoring access to the Online Store as soon as technically possible, whenever there are malfunctions under its responsibility that cause interruptions in its availability.
PRIVACY AND PERSONAL DATA PROTECTION
1. GLOBALSPORT guarantees, at all times, the confidentiality and protection of all data provided by Customers, particularly personal data.
2. The Customer’s personal data collected at the time of the Order will be processed and stored electronically by GLOBALSPORT, as the data controller, and are intended to be used within the scope of the contractual relationship with the Customer, in accordance with the provisions of applicable legislation and for the purposes determining their collection.
3. The Customer is guaranteed, without any costs, the right to access, rectify and update their personal data. 4. The Customer commits to respect and comply with all legal norms regarding privacy protection in the electronic communications sector.
LIABILITY
1. Without prejudice to the provisions of these Terms and Conditions, because the Products and Services made available by GLOBALSPORT through the Online Store on an open network are subject to interference, interruptions, disconnections or other anomalies, namely as a result of malfunctions, overloads, line loads or other eventualities to which GLOBALSPORT is unrelated, the Customer expressly acknowledges that no liability can be attributed to GLOBALSPORT regarding damages, potential or actual, which, directly or indirectly, may result for the Customer due to the occurrence of such events.
2. GLOBALSPORT will not be responsible, in particular, and except in cases of willful misconduct or gross negligence, for any losses suffered by the Customer, resulting from:
a) Delays, interruptions, errors, and suspensions of communications that originate from factors outside its control, namely, any deficiencies or failures caused by the communication network or communication services provided by third parties, by the computer system, modems, connection software, or possible computer viruses;
b) Loss of data, as well as suspension, interruption, or any other anomaly of the Online Store;
c) Accidental or voluntary damages caused to the Customer by third parties or resulting from their use of the Online Store.
3. GLOBALSPORT has implemented sufficient, necessary, and adequate security measures for data transmission over the Internet, however, and since data circulating on the Internet is not fully protected against possible violations or eventual deviations, the Customer acknowledges that they are solely responsible for communicating any username, access code, other confidential codes, and all sensitive information.
4. GLOBALSPORT is not responsible for any defects, incorrect operation, or incompatibility, particularly with Customers’ hardware, and is not obliged to provide support in the use of the Online Store, nor does it guarantee that it ensures the purposes intended by the Customer.
5. All operations carried out in the Online Store are presumed to be performed by the Customer, and GLOBALSPORT is not, under any circumstances, responsible for any abusive or fraudulent use.
6. The Customer is solely responsible for their use of all content and functionalities available in the Online Store and is solely liable for any damages, direct or indirect, caused to themselves, GLOBALSPORT, or any third parties, related to their use of the Online Store, committing to pay any compensation that may be awarded as a result of any action, claim, or conviction they may cause.
7. The Customer is also responsible for:
a) Acquiring and ensuring the maintenance of equipment (hardware) and computer programs (software) needed to access the Online Store;
b) Paying the costs associated with accessing the Online Store;
c) All information they make available on the Internet.
8. The Customer hereby acknowledges that the data circulating on the Internet may be protected by copyright or industrial property rights, and therefore assumes full and total responsibility for the use and storage of information collected on the Internet.
9. GLOBALSPORT does not guarantee that the characteristics of the Product and Service purchased by the Customer through the Online Store will meet their expectations.
INTELLECTUAL PROPERTY
The Online Store is a website registered by GLOBALSPORT, and the services provided through it are its responsibility. All trademarks, logos, and symbols used in the Online Store are the property of GLOBALSPORT, or it has obtained the appropriate authorization for their use.

APPLICABLE LAW AND JURISDICTION
1. For all matters not expressly regulated by GLOBALSPORT in these Terms and Conditions, Portuguese Law shall apply.
2. In case of dispute regarding the validity, effectiveness, interpretation, integration, application, or compliance with these Terms and Conditions, GLOBALSPORT and the Customer agree to submit it to the exclusive jurisdiction of the Court of the District of Porto, expressly waiving any other.
